Commercial License Agreement

1. License Overview

1.1 Standard Personal Use License (Included with All Plans)

All paid plans include a Personal Use License allowing:

• Private display in home or personal spaces.
• Personal social media sharing (non-commercial).
• Gifts to friends and family.
• Personal portfolio use (non-commercial).

Personal Use does NOT allow: Commercial sale, business marketing, product packaging, or client commissioned projects.

1.2 Commercial License (Requires Purchase)

A Commercial License grants expanded rights for business and commercial use as detailed below.

3. What's Included

License Grant: Non-exclusive, worldwide, perpetual rights to use and modify the artwork.

Ownership: You own the specific generated artwork. However, [Your Brand Name] retains IP rights to the underlying AI models. Others may generate similar (but not identical) art.

4. Permitted Commercial Uses

• Marketing & Advertising: Digital ads, billboards, brochures, and website hero images.
• Products & Merchandise (Extended Only): Apparel, home decor, stationery, and tech accessories.
• Publishing: Book covers, interior illustrations, and editorial use.
• Digital Products (Extended Only): Website templates, App UI elements, and NFTs.

5. Prohibited Uses

Even with a Commercial License, you may NOT:

• Claim Original Creation: You must not represent the artwork as a purely human-made creation without AI assistance.
• Trademark/Copyright: You cannot trademark the artwork as an “original” work of authorship.
• Sensitive Use: Use in defamatory, illegal, adult, or political content (without prior approval).
• Model Training: Use the artwork to train other AI models or create competing AI services.

6. Purchase & Verification

Proof of License: Upon purchase, you will receive a Digital License Certificate containing a unique License ID and Artwork ID. Keep this for your records.

Verification: We reserve the right to verify commercial usage against purchased licenses. Unauthorized use may result in legal action or account termination.

7. Refunds & Modifications

Refunds: Licenses are generally non-refundable once granted. Exchanges may be permitted within 7 days for incorrect license types.

Editing: You are permitted to modify the artwork (color grading, cropping, adding text) for your commercial projects.

8. Disputes & Liability

Liability: Loveframe is not liable for the commercial success of projects using the artwork. Our maximum liability is limited to the license fee paid.

Indemnification: You agree to hold Loveframe harmless from claims arising from your specific commercial use of the artwork.
